Welcome to SplitSmart, operated by Pockito Labs ("we", "our", "us"). By downloading or using SplitSmart, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using SplitSmart, you confirm that you are at least 13 years old and agree to be bound by these Terms. If you do not agree, do not use the app.

2. Description of Service

SplitSmart is a bill-splitting and expense tracking application that allows users to track shared expenses, split costs with others, and use AI-powered features to manage finances. We offer both free and paid (Pro) tiers.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials
You must provide accurate information when creating your account
You are responsible for all activity that occurs under your account
Notify us immediately of any unauthorized use of your account

4. Free and Pro Plans

Free Plan — SplitSmart offers full expense tracking functionality for free. We are committed to keeping core features free for all users.

Pro Plan — SplitSmart Pro includes additional features such as unlimited Penny AI interactions, advanced analytics, receipt scanning, CSV export, and more.

Changes to Pricing — If we ever move a currently free feature to Pro, we will notify users at least 30 days in advance. We will never surprise you with paywalls.

5. Subscriptions and Payments

Pro subscriptions are billed monthly or annually through the App Store or Google Play
Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
You can cancel anytime through your App Store or Google Play account settings
Refunds are handled according to Apple's or Google's refund policies
Prices may vary by region and are displayed in your local currency

6. Acceptable Use

You agree not to:

Use SplitSmart for any illegal purpose
Attempt to reverse engineer or hack the app
Upload malicious content or attempt to disrupt the service
Create multiple accounts to abuse free tier limits
Use the AI features to generate harmful or illegal content

7. AI Features

Penny AI and receipt scanning features are powered by third-party AI services (Anthropic). AI responses are for informational purposes only and should not be relied upon as financial, legal, or professional advice. We are not responsible for errors in AI-generated content.

8. Your Data

You retain ownership of all expense data and content you create in SplitSmart. By using the app, you grant us a limited license to store and process your data to provide the service. See our Privacy Policy for full details.

9. Disclaimer of Warranties

SplitSmart is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free, uninterrupted, or that all features will be available at all times. We are not responsible for any financial decisions made based on app data.

10. Limitation of Liability

To the maximum extent permitted by law, Pockito Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of SplitSmart, including but not limited to loss of data or financial losses.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or by email. Continued use of SplitSmart after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of El Salvador. Any disputes shall be resolved through binding arbitration or in the courts of El Salvador.
